Mark Sidney| Opinion| Flashback 8/10/20| The media is doing this nation a huge disservice when they refuse to make the distinction between a ‘protest’ and ‘violence’, a ‘riot’, or ‘looting,’ clear. Peaceful protests are part, a large part in fact, of what makes America great.

There are many nations on Earth in which airing your grievances with the government is forbidden. Protests are so important that they are covered by the very first Amendment to the Constitution of the United States.

However, just like with the 2nd Amendment, and the right to bear arms, with those rights come a lot of responsibility. Yes, you have the right to own a weapon and defend yourself, but no, you do not have a right to discharge your weapon in public without dire cause.

The same goes for the first Amendment, and it is all laid out there in the text of the Amendment itself:

‘Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.’

Peaceably to assemble,’ the key word being ‘peaceably.’ Now it seems that California Black Lives Matter leader, Tianna Arata, is learning that lesson the hard way after she organized a ‘protest’ and was subsequently arrested by the San Luis Obispo Police Department (SLOPD) after the event turned violent.

The Gateway Pundit explains ‘The San Luis Obispo DA filed five felony charges against Arata, including four felony counts of false imprisonment, and one felony count of conspiracy.

She was also hit with three misdemeanor charges: resisting or obstructing a peace officer, inciting a riot, and unlawful assembly.’

Ms. Arata is facing 15 years in prison.

Newsweek reported:

Activist Tianna Arata was arrested on July 21 by the San Luis Obispo Police Department (SLOPD) in California after police said a protest she organized turned violent.

In a statement released following Arata’s arrest, the department said SLOPD Police Chief Deanna Cantrell had spoken with Arata ahead of the rally and had been assured that the protest would be peaceful.

However, SLOPD said the protest, which grew to a demonstration involving approximately 300 people, got out of hand when demonstrators marched onto a highway and, at one point, launched an assault on a passenger vehicle, despite a 4-year-old child being inside.

It is unclear what led up to the incident, but SLOPD said protesters damaged the hood of the vehicle and smashed the rear window, causing glass to shatter on the 4-year-old, who was sitting in the back seat.

According to police, protesters also targeted at least two other vehicles upon exiting the highway, with some demonstrators seen chasing down and throwing objects at one car.

The protest, police said, “resulted in significant public safety risks for protesters and community members.”

Arata’s friend, Melissa Elizalde posted a video of the arrest online, in which she called the event a ‘kidnapping:’

“I just turned 20 last month, there’s so much that I want to accomplish,” Arata told The Tribune. “And I’ve been through so much struggle in my life that dealing with this, it’s just, like, I want to be able to overcome it and to go on to the new steps of my life.”

I’m sure if she just tells that judge that she will be fine … right?

I sure hope that the prosecution has more evidence that Ms. Arata was instrumental in the transition from ‘peaceable’ protest to violent, traffic blocking, kid terrorizing, criminal activity, if they want to lock her up for 15 years. If not, I am not so sure how I feel about her facing 15 years in prison because some people decided to break the law at an event she organized.

On the right we talk about personal responsibility a lot. We do not want to be held accountable for the actions of others, and that same right needs to extend to everyone. Unless Ms. Arata facilitated the violence, I do not see how she can be held responsible for the actions of others. What do you think?

  • By association is assimilation. She was part of the terrorism therefore should be charged. Had she walked away perhaps the charges would be reconsidered. But no, she actively participated, so she is guilty.

    • Her organizing this makes her responsible, she may have even known here would be bad actors present, ****(But maybe we should ask the hillary clinton/ barack obama gang)?

  • She saw what was happening. What did she do about it? If she tried reeling in those who were committing violent acts, then the courts should be lenient. If she did nothing, as I suspect was the case, then she has to be held accountable. It was her event and people participating in it committed felonies. She has no rocks left to crawl under.

    • Why is it always the cops fault? I have so many friends that are or were in law enforcement and one of the reasons they left was because the courts were to light on the perpetraitors and it is even worse today because the judges are affraid to punish these assholes that think they are above the law. Personally they should go back to old school and I’ll gaurentee this shit would stop quickly because if you knew you were going to get a good ass kicking you would think twice about comitting small crimes. I have no sympathy for these little pricks that think the world owes them everything. Get a fucking job and I don’t care if it is diging ditches instead of sitting around thinking something is going to come along that you want to do. My first job was bailing hay for $.85 per hour. Did I want to do that hell know but it taught me a lot about life and what you had to do to work your way up and you don’t need a college degree to get to the top!

      • The cops in my town are disgusted with the courts, the “joke” is the perpetrator will be released before the ink on the complaint is dry.

  • She knew how it would go down when they were just thinking about a protest/demonstration/riot. The riot was the plan. For BLM it is always the plan. Fifteen years is going easy on her.

  • She is still culpable in that she organized what turned out to be a violent event that caused property damage and unbelievable fear upon the community. She cannot hide behind a plea that she did not know what would happen having seen what had happened so often elsewhere.

    • Yeah, well she might be responsible for starting this crap and have to answer for it but even if she goes away for it, those same pieces of crap attacking the cars will come back and do it again. They’re so damn lucky it was not me in one of those cars, you all need to take a lesson from me. They attack me, I get out and knock ’em on their butt and make sure they don’t get back up again. I don’t get any of this bullshit because it’s a well known fact around here I won’t put up with it.
      I heard Tommy Lee Jones say in the movie “Lonesome Dave” when he beat the hell out of that Army scout, he said,,”I can’t stand rude behavior in a man, won’t tolerate it!” I have friends that say that sounds like me. But listen people, the only way you’ll get these morons to stop acting like a fool is to put ’em in their place, and if that means stomping a mud hole in their butt, you’ll just have to do it.

  • With our rights comes personal responsibility is a concept it seems the younger generations do not understand. Yes, you have the right to address your grievances towards the government, whether local, state or federal, but how you choose to voice them can be peaceably or by criminal actions. Once you start blocking lawful commerce, for instance, your actions are no longer peaceful. At that point, you’ve broken the law, no matter how worthy or just you feel your “cause” is.
    As for her removal by law enforcement, law enforcement had probable cause to detain her for her actions, and to question her, removed from the scene. Her Miranda rights do not have to be given at the scene, only when she’s formally arrested, so pipe down about your “sister’s” rights, because she abused the rights of those trying to go about their business while she had her temper tantrum protest turned Riot

  • The person at the top is responsible for everyone underneath them irregardless of the fact that controlling those under one’s watch is nearly impossible.

    Coprorate executives, captains of ships & planes, military leaders, et al, face this responsibility daily.

  • I have to disagree with the author of this article when he states: “Unless Ms. Arata facilitated the violence, I do not see how she can be held responsible for the actions of others.” Uh…HELLO??? She participated in the events that unfolded, she used a blowhorn which to spew the hate that came along with the riot; However, at least this 20 year old will have some time to reflect on her decisions. I’m sure George Soros will help her out.

  • She needs to be arrested for more than 15 years. She has been instrumental in many other protests and riots and looting. Her BLM stands for Burn Loot and murder. We need to set her up as a bad example. Her organization is misleading and funding is bad. She has done nothing to uplift the blacks, only to use them as tools for her bidding just as Soros uses her as a puppet in destroying the USA. She has turned many into terrorists and has encouraged racism and provoked anti-police. She should be deported and not supported by the people.

  • Arresting her is great but she’s done a lot more than that. And she should get more than 15 years for sure. Black Lives Matter movement has done nothing but brought this country down further in the black communities no matter what they think. I am not a racist I have never been a racist I’ve always treated everyone with respect they deserve. And Black Lives Matter gets none of my respect ever they have proven Criminal minds stand and totally taken away from the point they were trying to match.

  • But for her organizing the protest, the violence would not have happened. That would be like forgiving looters who took advantage of a storefront being broken. After all, they didn’t break the window, they just went into the store afterwards and loaded up on big screen tvs. If Charles Manson hadn’t told his “flock” to go to Sharon Tate’s house and kill everyone inside, she might still be alive today with her child. He perpetrated, they carried it out.

  • This disgusting, hateful and vicious vixen had better be put in prison for a long time or else MANY AMERICANS are going to be very unhappy with our Government. When these “sick twisted fkn animals” roam thru our streets in gangs burning , looting, assaulting and MURDERING innocent women & children they ONLY deserve 2 options for their works of mayhem, either a no bail arrest on serious felony punishable charges , OR, just a bullet in the back of the head……preferably and most desirably the latter of the 2 options. Who knows, maybe after a few days in a dangerous & deadly maximum sec. prison she will be wishing they would have put a bullet in her brain instead, and, to all of her accomplices as well! THESE PEOPLE REALLY NEED TO SWING just for the murders of women & children alone!

  • Since she organized the protest she has to take responsibility for the consequences. The lesson must be learned that violence and the destruction of property in the name of protest will not be tolerated.

  • Now get the rest of them. We may need to build a new prison, but it would be worth the expense. Lock them up for the rest of their lives. They have destroyed, killed, maimed and made this country the laughing stock of the world. How many countries that hate us are hatching up ways to get back at us. Time to end this.

  • This woman had a talk with police, prior to the event. She assured the cops there would be no violence. If there was an outbreak of violence, it was up to her to go to police and point out certain people causing the violence. She didn’t and some of her crowd started getting violent, I assume, when she was being arrested. She made a verbal agreement, as to the event being peaceful. She violated her verbal contract, which she was being held personally responsible. You don’t give your word to an agreement you won’t take responsibility for. This is a harsh dose of reality for someone that thinks she can do whatever she wants. Just because she is part of the Burn, Loot, Murder crowd, doesn’t mean you get a free pass. You should be careful of the people you call your friends. They can get you in a lot of trouble.

  • How many times have we heard this. She IS responsible since she organized this and should have had control of those she heads. NOT sorry for her. When you associate with criminals you will find yourself in jail. I hope it is for long enough that when she finally gets out, she will be to old to have children. Don’t want kids being raised by such a lunatic.
