Kirsters Baish’s Opinion| Former New York Mayor/personal attorney for President Donald Trump, Rudy Giuliani, revealed on Tuesday that he and other members of the Trump administration may be suing Congresspeople due to their, apparently allegedly illicit actions in an impeachment inquiry.
“I had a couple of talks with civil rights lawyer and a constitutional lawyer today and here’s what they’re recommending: that we should bring a lawsuit on behalf of the president and several of the people in the administration, maybe even myself as a lawyer, against the members of Congress individually for violating constitutional rights, violating civil rights,” Giuliani stated during an appearance on Fox News this week.
The President’s lawyer suggested that Congressional Democrats had violated Article II of the United States’ Constitution, which states that the president has the “power, by and with the advice and consent of the Senate, to make treaties, provided two-thirds of the Senators present concur.”
Giuliani continued, “They are doing extraordinary things. For example, they are violating — they’re interfering with the president in exercising his rights under Article II: The president United States conducts the foreign policy of the United States. They’re calling foreign leaders. They are going to foreign capitals.”
“This is worse than McCarthy,” he went on, referring to former Republican Senator Joseph McCarthy’s quest to find Communist supporters in the US during the 1950s.
According to Politico, “Ingraham appeared skeptical of Giuliani’s proposal, noting members of Congress have immunity for anything they say on the floor. ‘It’s novel,’ she said of Giuliani’s proposal.”
Take a look:
The Hill reports:
Giuliani’s comments come as House Democrats are looking into President Trump’s July 25 phone call with Ukrainian President Volodymyr Zelensky in which Trump is accused of pushing Zelensky to look into presidential candidate Joe Biden and his son for his own gain. The president has denied wrongdoing and the White House has released a partial transcript of the call.
“Biden went around bragging that he stopped the prosecution so if you can look into it … It sounds horrible to me,” Trump said on the call, according to the memo.
This should be interesting to see how it plays out. As far as I know, anything that is said my a member of Congress on the House or Senate Floor is privileged and immune from legal action. But that is just my understanding, it’s likely more complicated, and I’m not a lawyer.
Trump needs to act now or he will be bled to death, and next so will we, the American people.
